Article 1: Organisation

SAS BLACK CHEDDAR with a capital of 1000 €, hereinafter referred to as "the organiser", whose registered office is located at 10 RUE GRENETA 75003 PARIS, registered under the number RCS Paris 847794278, is organising a free game with no obligation to buy from 24/01/2025 to 31/01/2025 midnight (day included).

Article 2: Participants

This free, no-obligation game is open exclusively to people of legal age or under the age of majority at the start of the game, residing in mainland France (excluding Corsica).

Minors are allowed to take part in this game, provided that they have first obtained express authorisation to do so from their parents or the person exercising parental authority. The fact that they participate implies that they have obtained this authorisation.

Persons who do not meet the above conditions are excluded from the game, as are members of the staff of "L'organisatrice" and any person who has participated directly or indirectly in the design, production or management of the game, as well as their spouses and members of their families: direct ascendants and descendants or other relatives, whether or not living under their roof.

"The organiser reserves the right to ask any participant to provide proof of the above conditions. Any person who does not meet these conditions or refuses to provide proof will be excluded from the game and, if they win, will not be entitled to their prize.

Only one entry per person (same name, same address) is authorised. "The organiser reserves the right to carry out any checks to ensure compliance with this rule.

Participation in the game implies full acceptance of these rules.

Article 3: Terms and conditions of participation
Participants must go to the following URL address:

Participants must have downloaded the Black and White application on their mobile, entered their email address and followed our Instagram page @blackandwhiteburger to be able to win their prize and collect it. They must also enter the Black and White city where they will collect their prize (if it concerns a Food prize). Otherwise, they must contact us by email at concours@bnwburger.com and give us all the necessary information.
Only one entry per person is permitted.

The participant must fully and correctly complete the information form in order for his/her registration to be validated. The player is informed and accepts that the information entered in the registration form is proof of his/her identity.

Any participation made contrary to the provisions of these rules will render the participation invalid. Any participant suspected of fraud may be excluded from the competition by the "organiser" without having to justify this. Any identification or participation that is incomplete, erroneous or illegible, whether intentionally or not, or made in a form other than that provided for in these rules, will be considered invalid. The same penalty will apply in the event of multiple entries.

Article 4: Winnings
The prizes at stake are distributed as follows:

The value of the prizes is determined at the time these rules are drawn up and cannot be contested.

All costs incurred after the game, in particular for the upkeep and use of these prizes, are entirely at the winner's expense.

Article 5: Designation of winners

They will spin a wheel and land directly on their winnings.

Article 6: Announcement of winners
The game is 100% winning, and participants will know directly what they have won.

Article 7: Delivery of prizes
Winners of a Food prize will go directly to the restaurant of their choice to collect their prize.
The other winners will have to contact us by e-mail and we will make a hand delivery in one of our restaurants.

The prize will remain available to the participant for 15 days. After this period, it will no longer be available.

The winners undertake to accept the prizes as offered, without any possibility of exchange, in particular for cash, other goods or services of any kind whatsoever, or transfer of the benefit to a third party. Similarly, these prizes may not be the subject of requests for compensation.

"The organiser reserves the right, in the event of an event beyond its control, notably linked to its suppliers or to unforeseeable circumstances, to replace the prizes announced with prizes of equivalent value. The winner will be informed of any changes.

Article 8: Use of participants' personal data

Participants' details are recorded and used by "The organiser" to record their participation in the competition and to enable prizes to be awarded.

Participants may, for legitimate reasons, object to their personal data communicated in the context of this competition being processed. They also have the right to object to their personal data being used for commercial canvassing purposes, outside of participation in this competition, which they can exercise as soon as their participation has been registered by writing to "L'organisatrice" at the address given in article 1.

The winner(s) authorise "L'organisatrice" to use their contact details (surname, first name) for advertising or public relations purposes, in any medium whatsoever, without this conferring on them any remuneration, right or advantage whatsoever, other than the award of their prize.

In accordance with the French Data Protection Act (Loi Informatique et Libertés) in its latest version, and with Regulation no. 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (RGPD), participants may exercise their right of access, rectification, deletion of data, limitation of processing, right to data portability, right to object and right to withdraw their consent by writing to "The organiser" at the address given in article 1.

Article 9: Game rules

The rules of the game have been filed with SELARL ACTA - PIERSON et ASSOCIES, a bailiff's office located at 15 rue de Sarre BP 15126 57074 METZ Cedex 3.

It may be sent free of charge to any person who requests it from "The organiser".

"The organiser reserves the right to extend, shorten, modify or cancel the competition at any time, particularly in the event of force majeure, without participants being able to claim any compensation. The rules, as amended by amendment(s), will be filed, where applicable, with SELARL ACTA - PIERSON et ASSOCIES, a bailiff's office with its registered office at 15 rue de Sarre BP 15126 57074 METZ Cedex 3.

Article 10: Industrial and intellectual property

The reproduction, representation or use of all or part of the elements making up the game, including these rules, is strictly prohibited.

All trademarks, logos, texts, images, videos and other distinctive signs reproduced on the site and on sites to which it provides access via hypertext links are the exclusive property of their owners and are therefore protected by the provisions of the French Intellectual Property Code throughout the world. Their unauthorised reproduction constitutes an infringement punishable by law.

Any unauthorised reproduction, in whole or in part, of these trademarks, logos and signs constitutes an infringement punishable by law.

Participation in this game implies full acceptance of these rules by the participants.

Article 11: Liability
The organiser may not be held liable in the event of force majeure or an act of God beyond its control.

"The organiser cannot be held responsible for delays, loss, theft, damage to mail or illegibility of postmarks due to the postal services. Nor shall it be held liable, and no recourse may be taken against it, in the event of events of a force majeure nature (strikes, bad weather, etc.) partially or totally depriving participants of the opportunity to take part in the game and/or the winners of the benefit of their winnings.

"The organiser and its service providers and partners may under no circumstances be held responsible for any incidents that may occur in the use of the prizes by the beneficiaries or their guests once the winners have taken possession of them.

Likewise, "The organiser", as well as its service providers and partners, may not be held responsible for the loss or theft of the prizes by the beneficiaries once the winners have taken possession of them. Any additional cost required to take possession of the prizes shall be borne entirely by the winners, who may not claim any compensation whatsoever from "The organiser", nor from the service providers or partners.

Article 12: Disputes & complaints
These rules are governed by French law.

"The organiser reserves the right to rule without appeal on any difficulty that may arise regarding the interpretation or application of these rules, it being understood that no dispute will be admitted, particularly regarding the terms and conditions of the game, the results, the winnings or their receipt, one month after the end of the game. Except in the case of obvious errors, it is agreed that the information resulting from the "L'organisatrice" game systems has probative force in any dispute as to the connection elements and the computer processing of said information relating to the game.

All claims must be sent to "The organiser" within one month of the end date of the game. After this date, no claims will be accepted. Participation in the game implies full acceptance of these rules.

Article 13: Evidence agreement
By express agreement between the participant and "The organiser", only "The organiser's" computer systems and files will be deemed authentic.

The computerised registers, kept in the computer systems of "L'organisatrice", in reasonable conditions of security and reliability, are considered as proof of the relations and communications between "L'organisatrice" and the participant.

It is therefore agreed that, in the absence of manifest error, "The organiser" may rely, in particular for the purposes of proof of any act, fact or omission, on the programmes, data, files, recordings, operations and other elements (such as monitoring reports or other statements) of a computer or electronic nature or format, established, received or stored directly or indirectly by "The organiser", in particular in its computer systems.

The elements considered thus constitute proof and if they are produced as means of proof by "L'organisatrice" in any litigation or other proceedings, they will be admissible, valid and opposable between the parties in the same way, under the same conditions and with the same probative force as any document that would be drawn up, received or kept in writing.

Operations of any kind carried out using the identifier and code allocated to a participant following registration are irrevocably presumed to have been carried out under the participant's responsibility.
